MakeBrainrot provides an AI-powered image transformation service that allows users to transform their photos into various artistic styles, including but not limited to Studio Ghibli, Pokémon, Cyberpunk, South Park, and Coloring Page styles.

Our Services include:

  • AI-powered image transformation in multiple artistic styles
  • Storage of your original and transformed images in your account
  • Ability to download and share your transformed images
  • Access to new styles as they become available

We reserve the right to modify, suspend, or discontinue any part of our Services at any time without prior notice.

3. User Accounts and Registration

To access certain features of our Services, you must create an account. When you create an account, you agree to provide accurate, current, and complete information and to update such information to keep it accurate, current, and complete.

You are solely responsible for:

  • Maintaining the confidentiality of your account and password
  • Restricting access to your account
  • All activities that occur under your account

You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this section.

We reserve the right to suspend or terminate your account and your access to the Services if you violate these Terms or if we determine, in our sole discretion, that your account is being used for fraudulent or unauthorized purposes.

4. Payment Terms and Credits

MakeBrainrot operates on a credit-based system. Users can purchase credits that can be used to transform images using our Services.

New users receive 5 free credits upon account creation. Additional credits can be purchased through our website according to our current pricing structure.

Credit terms:

  • Each style transformation costs 1 credit
  • Credits do not expire once purchased
  • Credits are non-refundable and non-transferable
  • We reserve the right to modify our credit pricing at any time

Payment processing is handled by secure third-party payment processors. By making a purchase, you agree to their terms and conditions as well.

We reserve the right to refuse or cancel any order or purchase of credits for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity.

5. User Content and Licensing

By uploading or submitting any images or content to our Services ("User Content"), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such User Content solely for the purpose of providing and improving our Services.

You represent and warrant that:

  • You own or have the right to use and authorize us to use your User Content
  • Your User Content does not violate the rights of any third party, including copyright, trademark, privacy, or publicity rights
  • Your User Content does not contain illegal, obscene, offensive, or defamatory material

Ownership of transformed images:

  • You retain ownership of your original uploaded images
  • You own the rights to your transformed images and may use them for personal or commercial purposes
  • We retain the right to use, display, and showcase transformed images for promotional and demonstration purposes (such as "before and after" examples), unless you explicitly opt out by contacting us

6. Intellectual Property Rights

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and the compilation thereof, are owned by MakeBrainrot, our licensors, or other providers of such material and are protected by copyright, trademark, and other intellectual property laws.

Our name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of MakeBrainrot or our affiliates. You may not use such marks without our prior written permission.

AI technology and artistic style disclaimer: Our AI transformation technology creates images inspired by various artistic styles. We do not claim to reproduce exact copies of any artist's work, and our Services are not affiliated with, endorsed by, or connected to any third-party brands, franchises, or artists that may be associated with the style names we use (such as "Studio Ghibli Style" or "Pokémon Style").

7. Prohibited Uses

You agree not to use our Services:

  • In any way that violates any applicable federal, state, local, or international law or regulation
  • To transmit, upload, or share any content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
  • To upload or share any content that infringes any patent, trademark, trade secret, copyright, or other intellectual property rights of any party
  • To create, generate, or share explicit, pornographic, or sexually suggestive content
  • To create, generate, or share content that promotes discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group
  • To create deepfakes or misrepresentations of real individuals without their consent
  • To impersonate or attempt to impersonate MakeBrainrot, a MakeBrainrot employee, another user, or any other person or entity
  • To engage in any activity that could disable, overburden, damage, or impair our Services or interfere with any other party's use of our Services
  • To access or attempt to access any part of our Services by any means other than through the interface we provide
  • To use any automated means or processes to access, retrieve, scrape, or index our Services or any content on our Services

We reserve the right to terminate or restrict your access to our Services for any violation of these prohibited uses.

8. Termination

We may terminate or suspend your account and access to our Services immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

Upon termination:

  • Your access to our Services will be terminated
  • Any unused credits will be forfeited
  • Your data and content may be deleted from our systems, subject to our data retention policies

You may terminate your account at any time by contacting us at [email protected]. Termination of your account does not entitle you to any refund of purchased credits.

All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Disclaimers and Limitations of Liability

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Services will function uninterrupted, secure, or available at any particular time or location
  • Any errors or defects will be corrected
  • The Services are free of viruses or other harmful components
  • The results of using the Services will meet your requirements

Limitation of liability:

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MAKEBRAINROT, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES
  • ANY CONTENT OBTAINED FROM THE SERVICES
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU TO US DURING THE PAST SIX MONTHS.

10. Indemnification

You agree to defend, indemnify, and hold harmless MakeBrainrot, its directors, employees, partners, agents, suppliers, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services, including, but not limited to, your User Content, any use of the Services' content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Services.

11. Governing Law and Dispute Resolution
